(1)Sunken ships and sunken articles raised in PRC inland sea or territorial sea belong to PRC, and foreign businesses will share the benefits from the retrieved objects or their value in price in accordance with relevant stipulations in the joint salvage or cooperative salvage enterprise contracts.

(2)Coastal waters refer to inland sea and territorial sea of the PRC (PRC)and sea areas under the jurisdiction of PRC.

( 二)沿海水域,是指中华人民共和国内海、领海和属于中华人民共和国管辖的其他海域。

When foreign companies, enterprises and other foreign economic organizations or individuals have the necessity to lay submarine cables and pipelines, and also to conduct investigations and survey of routes and other relevant activities for the aforesaid engineering projects in the inland seas and territorial seas of the PRC , they shall, in accordance with these Provisions, apply to the competent authorities for approval;

外国的公司、企业和其他经济组织或者个人需要在中华人民共和国内海、领海铺设海底电缆、管道以及为铺设所进行的路由调查、勘测等活动,应当依照本规定报经主管机关批准;

Article 3 The competent authorities for the administration of the laying of submarine cables and pipelines in such areas as the said inland seas, territorial seas and continental shelves, and also for the investigations and survey of routes and other relevant activities for the aforesaid engineering projects, shall be the State Oceanographic Bureau of the PRC (hereinafter referred to as "the competent authorities").

第三条 在中华人民共和国内海、领海及大陆架上铺设海底电缆、管道以及为铺设所进行的路由调查、勘测及其他有关活动的主管机关是中华人民共和国国家海洋局(以下简称主管机关)。

Article 2 These Provisions shall apply to the laying of submarine cables and pipelines in such areas as inland seas, territorial seas and continental shelves under the jurisdiction of the PRC , and also to the investigations and survey of routes and other relevant activities conducted for the aforesaid engineering projects.

第二条 本规定适用于在中华人民共和国内海、领海及大陆架上铺设海底电缆、管道以及为铺设所进行的路由调查、勘测及其他有关活动。

When foreign vessels have the necessity to enter China's inland seas and territorial seas to carry out activities in the maintenance, alteration, or dismantling of submarine cables and pipelines, the owners shall, in addition to going through the procedures as prescribed in the first paragraph of this Article, submit an application to the administrative department concerned in China for approval, in accordance with the pertinent provisions of China's laws.

外国船舶需要进入中国内海、领海进行海底电缆、管道的维修、改造、拆除活动时,除履行本条第一款规定的程序外,还应当依照中国法律的规定,报经中国有关机关批准。

Article 13. In the case of foreign businesses taking part in salvaging sunken ships and sunken articles in the inland sea or territorial sea of PRC, the foreign businesses should bear all the coasts and economic risks involving throughout the period of salvage operations. Chinese salvage operators are responsible for coordination work with the departments concerned, attend to the performance of necessary procedures and exercise supervision and protection of salvage operations.

第十三条外商参与在中华人民共和国内海或者领海内打捞沉船沉物,应当承担打捞作业期间的全部费用和经济风险。中方打捞人负责与有关部门的协调,办理必要的手续及打捞作业期间的监护。
